Deck Forge Games Pty Ltd (ABN 33 697 206 205) (“Deck Forge”, “we”, “us”, “our”) operates this website and provides trading card game products, including individual cards, sealed products, and accessories (collectively, the “Services”).

These Terms govern your use of the Services. By using the Services, you agree to these Terms and our Privacy Policy available at:

SECTION 1 – ACCESS AND ACCOUNT

If you are under 18 years of age, you may only use the Services with the involvement and consent of a parent or legal guardian.

You agree to provide accurate and complete information and are responsible for all activity conducted through your account.

SECTION 2 – OUR PRODUCTS

We sell trading card game products including:

• Individual cards (singles)

• Sealed products

• Accessories

We make reasonable efforts to accurately describe products. However:

• Product images may not represent the exact item received

• Condition grading is subjective

• Minor imperfections may exist, even in Near Mint cards

We assess card condition using internal grading standards aligned with common industry practices. Where applicable, grading terminology (e.g. Near Mint, Lightly Played, Moderately Played) reflects general industry expectations.

We do not guarantee consistency with third-party grading services.

Nothing in this section limits your rights under the Australian Consumer Law.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase.

We may accept or decline orders at our discretion.

We may cancel orders due to:

• Fraud or suspected misuse

• Pricing errors

• Stock issues

If a pricing error is identified before dispatch, we will:

• Notify you; and

• Offer the option to proceed at the correct price or cancel for a full refund

SECTION 4 – PRICING AND BILLING

All prices are in Australian Dollars (AUD).

Prices, shipping costs, and any applicable fees are displayed at checkout and may change from time to time.

You agree to provide accurate payment details.

We accept payments via Shopify Payments and PayPal.

SECTION 5 – SHIPPING AND DELIVERY

We ship within Australia only.

Shipping options, costs, and delivery estimates are displayed at checkout.

Free shipping thresholds (if applicable) are displayed on our website and at checkout and may change from time to time.

Orders are typically processed within 3 business days.

Delivery timeframes are estimates only.

Risk in goods passes to you upon dispatch, except where required otherwise under the Australian Consumer Law.

For untracked shipping, you accept the risk of loss once dispatched.
This does not affect your rights under the Australian Consumer Law.

SECTION 6 – RETURNS AND REFUNDS

We comply with the Australian Consumer Law.

Your Rights

You are entitled to a remedy if a product:

• Is faulty

• Is not as described

• Is not fit for purpose

Major vs Minor Failures

• Major failure: You may choose a refund or replacement

• Minor failure: We may choose to provide a repair, replacement, or refund

Where appropriate, we may also offer store credit as an alternative resolution.

Store Credit

Store credit:

• Is issued at our discretion unless required otherwise under the Australian Consumer Law

• Does not expire

• Can be used on all products available on our website unless otherwise stated

• Is non-transferable and not redeemable for cash

Process

To request a return or refund:

• Contact us within a reasonable timeframe of receiving your order

• Provide details and supporting evidence (e.g. photos)

We aim to respond to return or refund requests within 5 business days.

Where required under the Australian Consumer Law, we will cover return postage costs.

Change of Mind

We do not offer returns for change of mind.

SECTION 7 – INTELLECTUAL PROPERTY

All content on the Services is owned or licensed by us, or used with permission from the relevant rights holder.

Trading card products may include intellectual property owned by third parties (e.g. game publishers).

The purchase of trading card products does not grant any licence to reproduce, distribute, or commercialise the intellectual property contained within those products.

SECTION 8 – THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools and links.

We are not responsible for third-party content or services.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify.

All purchases are made directly with Deck Forge. Shopify is not responsible for transactions between you and us.

SECTION 10 – PRIVACY

SECTION 11 – FEEDBACK

If you provide feedback, you grant us a perpetual, non-exclusive, royalty-free licence to use that feedback for the purposes of improving our products and services.

We may correct errors or inaccuracies and cancel affected orders where necessary.

SECTION 13 – PROHIBITED USES

You must not use the Services unlawfully or in a way that harms us or others.

Prohibited activities include:

• Submitting fraudulent orders

• Using automated tools to scrape data from our website without our prior written consent

We may suspend or terminate access for breaches.

• Our liability is limited to replacement, repair, or refund

• We are not liable for indirect or consequential loss

Nothing excludes your statutory rights.

You agree to indemnify us against claims arising directly from your fraudulent conduct or wilful misuse of the Services.

SECTION 18 – SEVERABILITY

Invalid provisions will not affect the remainder of these Terms.

SECTION 19 – ENTIRE AGREEMENT

These Terms and our policies form the entire agreement.

SECTION 20 – GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

You submit to the non-exclusive jurisdiction of the courts of New South Wales, without limiting any rights you may have under the Australian Consumer Law.

SECTION 21 – CHANGES TO TERMS

We may update these Terms from time to time.

For material changes, we will provide reasonable notice before they take effect.
